PUBLIC NOTICE
Pursuant to the Surface Mining Conservation and Reclamation Act, the Pennsylvania Department of Environmental Protection Rules and Regulations, and the Clean Streams Law notice is hereby given that Collier Land & Coal Development, LP, 223 Fourth Avenue 4th Floor, Pittsburgh, PA 15222, has made application to the Pennsylvania Department of Environmental Protection (DEP) to request authorization for a major permit revision to the existing surface mine permit and related NPDES permit. This request includes a change in the grading and reclamation plan, operations plan and a change in the water handling procedure to implement best management practices to control shallow ground water and elimination of storm water infiltration flowing to pre-existing pollution discharges from the abandoned deep mine workings. Water handling will consist of the use of other approved techniques known as BAT (Best Available Technology) as per 40 CFR Part 434. An abandoned deep mine lies underneath the surface mine operation and is discharging elevated aluminum and acidic water to the existing watershed. The operator proposes several best management practices to reduce acidity and sediment laden aluminum from draining to the preexisting mine discharge. The receiving streams for the permit area drain to an unnamed tributary to Robinson Run. The operation is located on 35.8 acres of land located in Collier Township, Allegheny County and is known as the McHugh Residential Estates surface mine, SMP No. 02070104. The surface mining activity area lies northeast of the intersection of Noblestown Road and Nike Site Road and west of McMichael Road. The surface mine permit boundary is contained entirely within surface lands owned by the permittee. The area described is located on the Oakdale, PA USGS 7.5 minute quadrangle map .
A copy of the application is available for public inspection at the New Stanton District Mining Office, 131 Broadview Road, New Stanton, PA 15672. Written comments, objections, or a request for an informal conference may be submitted to the PA Department of Environmental Protection, New Stanton District Office, P.O. Box 133, New Stanton, PA 15672, within thirty (30) days following the date of the final (4th) publication of this notice, and must include the person's name, address, telephone number, and a brief statement as to the nature of the objection(s).
